IP Protection with Standard Essential Patents (SEPs)

Standard essential patents (SEPs) are patents that protect core inventions necessary for complying with an industry-standard technology (such as, 5G, Wi-Fi, or video compression, etc.). Because these technical standards ensure global interoperability, manufacturers cannot design, build and market compliant devices—like autonomous vehicles or smartphones—without using these patents; hence, such patents are considered indispensable.

Therefore, a patent is deemed "essential" when another technically feasible alternative to the use of that patented invention is unavailable for complying with a recognized industry standard.

Justification for SEPs

Technological standards are typically developed by standards bodies and organisations, such as, the Institute of Electrical and Electronics Engineers (IEEE), the International Telecommunication Union (ITU), etc.

Technical standards ensure quality, safety, reliability, efficiency, interoperability, regulatory compliance, and compatibility, across products and services, particularly in the technology-driven sectors of automobiles, telecommunications, consumer electronics, computers, Internet of Things (IoT), etc.

Cutting-edge technologies in hi-tech sectors are usually protected by hundreds of SEPs owned by numerous innovators. For the design, manufacture and marketing of such cutting-edge, standards-compliant products, enterprises must therefore obtain SEP licenses, which makes them a critical aspect of commercialisation of standardized technologies.

SEPs obviously play a cardinal role in modern innovation ecosystems. An effective SEP framework facilitates globalization; reduces market fragmentation; and, promotes industry-standards compliance; and, supports continued investment in research and development.

Regulatory Interventions

In order to balance the interests of patent holders, on one hand, and product manufacturers and technology implementers, on the other, standards organisations generally require SEP owners to commit to licensing their patents on FRAND (Fair, Reasonable, and Non-Discriminatory) terms.

The objectives of FRAND frameworks are to: (a) ensure licensing terms do not unfairly favour the patentee; (b) fix royalties that reasonably reflect the intrinsic value of the patented invention; and, (c) provide access to all manufacturers in a non-discriminatory manner.

Thus, FRAND terms ensure access of standards to any party intending to develop products based thereon. They also deter monopolistic and restrictive trade practices. Given the indispensable nature of SEPs, FRAND terms prevent patent holders from charging exorbitant royalties or refusing access to essential technologies.

Concluding Remarks

Judicial and anti-trust authorities in many jurisdictions have developed and recommended practices and principles that govern FRAND negotiations, injunctions, and anti-trust action; approaches vary internationally though. However, despite such regulatory stipulations on FRAND-based licensing, SEPs are often the subject of intense global legal battles, monetary disputes and infringement litigation.

Common disputes revolve around: (i) identifying patents that are truly essential; (ii) determining suitable FRAND royalty rates;(iii) preventing SEP owners from “holding-up" agreements with unreasonable licensing terms; and, (iv) avoiding "hold-outs" by technology implementors with delays and refusals in license negotiations.

As technologies become increasingly interconnected, standard essential patents (SEPs) will continue to grow in economic and strategic stature. Hence, they remain a crucial cornerstone of innovation and constitute a confluence of patent, competition, and international trade laws.
