The Patent Prosecution Highway (PPH) is an international framework of agreements among patent offices that speeds up the examination process. It enables applicants to obtain accelerated examination of patent applications based on favorable examination results issued by another participating patent office.
The main objective of the PPH is to improve the efficiency and quality of patent application examination while reducing duplication of effort across jurisdictions. By leveraging one patent office’s work, other offices can expedite the examination process, thereby benefiting both applicants and patent authorities.
When a patent application in multiple geographies, the patent office in each jurisdiction evaluates the application for patentability from scratch. This can lead to long wait times and inconsistent decisions.
Under the PPH system, the process is streamlined.
When a patent office acting as the Office of First Filing (OFF) or Office of Earlier Examination (OEE) issues a ruling determining that one or more claims in the patent application is allowable/patentable, then the applicant may seek accelerated examination of corresponding claims under the PPH process.
Thereafter, while filing an application with the Office of Second Filing (OSF) or the Office of Later Examination (OLE) of another participating country, the applicant can submit the favourable examination results from the OFF and may request accelerated examination of corresponding claims under the PPH system.

The second office then fast-tracks the application and re-uses the search and examination work of the first office. The applicant though must demonstrate sufficient correspondence between the claims pending before the second office and the claims allowed by the first office.
However, all statutory and procedural requirements prescribed by the receiving patent office must be complied with.
The PPH offers several advantages.
It significantly expedites and reduces the time for issuance of patents in multiple jurisdictions. Obviously, applicants benefit from significantly reduced prosecution timelines.
Such accelerated patent grants help raise capital from investors; enhance commercialization opportunities; and, provide quicker legal certainty regarding patent rights. By eliminating repetitive searches, it also leads to lower legal fees and translation costs.
Patent offices benefit too from increased examination efficiency―the utilisation of prior search and examination results reduces workload, and promotes consistency in examination practices. Thus, the PPH process encourages greater harmonization of patenting standards and fosters international collaboration among patent offices.
Downside of the PPH System
Despite its advantages, the PPH has some limitations.
Participation is restricted to patent offices that have entered into PPH agreements, and each office retains complete authority to independently assess satisfaction of the patentability requirements under its patent laws.
Furthermore, a favorable examination outcome in one jurisdiction does not necessarily guarantee patent grant in another, as differences in patent eligibility, novelty, inventive step, and claim interpretation may lead to different outcomes. Applicants too must ensure substantial correspondence between claims across jurisdictions, which may require customized claims drafting and strategic amendments to claims.
Patent offices in some jurisdictions maintain specific PPH pilot programs. For instance, the Indian Patent Office (IPO) has operated a PPH program in collaboration with the Japan Patent Office (JPO). Local applicants can also use the PCT-PPH route to request accelerated examination internationally, if their Patent Cooperation Treaty (PCT) application has been positively reviewed by any major international searching authorities.
Overall, the Patent Prosecution Highway (PPH) system is a great mechanism for streamlining global patent prosecution. By accelerating examination, the PPH process supports innovation; reduces administrative burden; and, facilitates more efficient protection of inventions.
