Accurate Claims Scoping with Reissue Patent

A reissue patent is an official mechanism that enables a patentee to rectify typographical mistakes, clerical and other errors in a granted patent without loss of the original filing date. It is a proceeding initiated with the jurisdictional patent office to amend a substantive error in an issued patent.

A patent may be eligible for reissue, provided the office concerned holds that the patent is either wholly or partly invalid or inoperative due to any inadvertent error(s) made without deceptive intent.

The reissue patent corrects the flaw by replacing the original (erroneous) patent. However, it does not extend the validity term of patent, which retains the original priority and expiration dates.

Reasons for Reissue Patent Filings

A patentee can pursue a reissue if the granted patent is partially or completely invalid due to an honest mistake made without deceptive intent. Genuine errors that can be corrected with reissue patents include:

  1. Incorrect claims scope: Claims are either: (i) too broad, and thereby infringe prior art; or, (ii) too narrow, and hence, miss out on the full scope of invention;
  2. Defective specifications/drawings: Confusing diagrams and inaccurate descriptions often do not enable the making or using of the invention; and consequently, fail to claim the full scope thereof;
  3. Administrative Errors: Incorrectly claimed priority to a foreign or previously filed application.

In some geographies, patent law permits inventors to file a simple Certificate of Correction for minor clerical or typographical mistakes. Reissue patents are reserved for substantive errors that impact the invention’s scope materially and affect the validity or enforceability of patent rights.

Key Considerations

Through the reissue process, the patent owner can amend claims, edit drawings, revise specifications, or generally correct other defects to accurately align the patent with the disclosed invention.

No novel, inventive steps; unoriginal functions, or new subject matter can be introduced though. Further, the reissued patent is not accorded any time extension; its validity lasts for the unexpired time in the original patent’s term.

In many jurisdictions, if the patentee seeks to broaden the scope of claims, a “Two-year Rule” applies—that is, the reissue application must be filed within a two-year window from the grant date of the original patent. On the other hand, amendments for narrowing claims may be sought at any time during the validity period of the patent.

Benefits of the Process

The reissue process facilitates the accurate reflection of the actual invention in the awarded patent; it ensures the proper conferment of rights to which the patentee is legally entitled. Reissue patents are significant in many jurisdictions, where they provide a means for rectifying genuine mistakes that may have crept into the patenting process during drafting, filing or other pre-grant prosecution step.

During the reissue examination process, the patent office reassesses the amended claims for conformance with patentability criteria of novelty, utility, inventive step (or non-obviousness), and adequate disclosure. Third parties too may be afforded certain equitable rights, such as intervening rights, which protect those who relied on the original patent claims before the reissue was granted.
